NTSB announces safety recommendations to be made in aftermath of Comair Flight 5191 disaster

The American National Transportation Safety Board has announced that it will make new airline safety recommendations. This comes a result of its investigation into the Comair Flight 5191 disaster, in which a Bombardier Canadair Regional Jet (CRJ) CRJ-100ER crashed whilst attempting take-off from the wrong runway at Blue Grass Airport, Lexington, killing 49 people and leaving just one survivor. The plane was unable to take off because that runway was too short.

The NTSB has now announced that, on July 26, the date on which the NTSB is to determine the probable cause of the accident, they will issue safety recommendations regarding methods of preventing a recurrence of the disaster.

One of the recommendations will concern developing and implementing a cockpit-based system that will inform pilots when they are in the wrong location. Another will involve rescheduling the workloads of Air Traffic Controllers to ensure they receive more sleep, a request they had previously made in April.

Regarding location warning systems, the FAA has pointed out that they have been working on methods of preventing runway incursions (in which a person, ground vehicle or another aircraft is on the runway when or where it should not be), to which the National Transportation Safety Board chairman Mark Rosenker responded “The FAA is doing a great job testing these systems. The question we have is, when will you finally implement that technology?” FAA Associate Administrator Margaret Gilligan responded by saying that they were currently looking at just such a system, adding “We do have airlines that have committed to put that technology on the flight deck once it’s approved”. The system referred to involves runway signal lights and is currently being tested at Dallas-Fort Worth International Airport.

The NTSB will also look at runway and taxiway markings and the ways they can confuse pilots, as this issue has been identified as a contributing factor in the accident. Rosenker said the NTSB was “very interested” in this area. 140 airports have unclear or confusing markings in the US, but it is not certain if Blue Grass Airport is one of them. However, the Air Line Pilots Association (ALPA) made a submission to the NTSB stating that they had found that the markings at Blue Grass Airport did not match those on the charts the pilots were using. ALPA went on to recommend greater standardisation of airport runway markings.

Blue Grass Airport responded yesterday by saying that there was nothing wrong with their runway markings, with spokesman Brian Ellestad saying “We have had numerous inspections before and after (the Comair crash) and have had no issues… FAA reiterates that we meet all requirements for signage, markings, lighting, runways and taxiways.”

13 schools torched in southern Thailand

In an apparent coordinated attack, 13 schools were set ablaze late yesterday in southern Thailand, an escalation of violence that authorities are blaming on Muslim insurgents.

The 13 schools were burned in Pattani and Yala, two of the three restive, Muslim-majority Thai provinces on the border of Malaysia.

On Monday in the third province, Narathiwat, three teachers were fatally shot. Two female teachers, both Buddhist, were fatally shot while on lunch break at Bansako School in Si Sakorn. A male teacher from another school was gunned down while buying cigarettes at a store in Ra-ngae. On Tuesday morning in Yala’s Raman district, a 60-year-old Muslim teacher was fatally shot in his pick-up truck on the Raman-Balo road.

Since 2004, more than 200 schools have been burned in arson attacks and 77 teachers killed, education officials say. About 110 schools in Narathiwat and Yala provinces have been temporarily closed, while officials re-assess the security situation.

Teachers and schools, potent symbols of the Buddhist majority Thai central government, are prime targets in the Muslim insurgency in south Thailand, which has seen a steady escalation since 2004, with almost daily fatal shootings and bombings, killing more than 2,300 people.

School staff called on the government to provide better security. Many teachers travel with armed escorts, or have taken to carrying firearms themselves.

“We want school compounds to be safe areas for teachers. Today we have no safe areas for teachers, be they houses, communities or schools,” Vicharn Athikapan, chairman of the Confederation of Southern Teachers, was quoted as saying by the Bangkok Post yesterday. “Although it is difficult to deploy soldiers to protect teachers at schools, the state must do it.”

Today, a Royal Thai Army soldier was seriously injured in the explosion of a roadside bomb, which was placed opposite a vocational college in Narathiwat.

Late yesterday evening (local time), a 44-year-old man was killed in a drive-by shooting in Yala. Earlier, in Narathiwat’s Rueso district, three men were fatally shot, and one was beheaded. The beheading was the 10th this year, and one of 25 in southern Thailand since 2004.

Also yesterday, one soldier was killed and another injured in a roadside bomb near a school in Thung Yang Daeng, Pattani. Another soldier was killed and six others injured in Pattani’s Yarang district when a roadside bomb ripped through the pickup truck they were riding in.

On Tuesday in eastern Thailand‘s Sa Kaeo Province, on the border with Cambodia, police detained 15 Cambodian Muslims after one of the group was found to be carrying items that could be used to make bombs.

The owner of the bag told police he was carrying the items for a friend in southern Thailand, and were to be used to make explosives for catching fish. The items were seized, and all 15 men were sent back to Cambodia.

The incident follows a diplomatic flare-up last weekend between Thailand and Cambodia, after published comments were attributed to Thai General Wattanachai Chaimuenwong, saying Cambodian Muslims have links to the Jemaah Islamiyah terrorist organization, as well as the south Thailand insurgency.

Wattanachai, an adviser to Prime Minister Surayud Chulanont, later denied making the statements, after Cambodian Prime Minister Hun Sen issued an angry rebuke against Thai officials.

“Because of their own weakness, they are now finding others to blame,” Hun Sen was quoted as saying by the Associated Press.

Madagascar leader names army officer as prime minister

Madagascar’s leader, Andry Rajoelina, has named a high-ranking army officer as the country’s new prime minister, and announced he is abandoning a power-sharing deal with the opposition.

Mr. Rajoelina’s office announced Sunday that Colonel Camille Albert Vital would serve as the new prime minister, replacing Eugene Mangalaza, who was supposed to be prime minister under the deal. Previously he had been expected to make Cecile Manorohanta the new prime minister. He also abolished the posts of co-president.

In a nationally broadcast address, Colonel Vital said that organising elections and increasing security were his priorities. He called on the people of Madagascar, including political rivals, to work with his government.

Mr. Rajoelina took power in a coup last March. On Wednesday, he appeared on national television to announce that parliamentary elections would take place March 20 next year. He made no mention of presidential elections.

International mediators have brokered several power-sharing agreements in recent months, but all have been unsuccessful. The African Union and other regional bodies have refused to recognize Mr. Rajoelina’s presidency.

Zimbabwe submits to popular pressure: foreign currencies now legal tender

Zimbabwe has decided to abandon its currency, the Zimbabwean dollar, in favour of other currencies.

Acting Finance Minister Patrick Chinamasa announced today that Zimbabweans will be allowed to make transactions in other currencies along with the local currency. “In line with the prevailing practices by the general public, [the] government is therefore allowing the use of multiple foreign currencies for business transactions alongside the Zimbabwean dollar,” he said, adding that the Zimbabwean dollar will not be removed from circulation and would be used alongside other currencies.

This decision comes during the current period of hyperinflation, which has massively devalued the Zimbabwean dollar. Banknotes up to $100 trillion have been printed, despite the removal of ten zeroes from the currency last summer to try to make transactions easier. The official inflation rate, last updated in July 2008, was 231,000,000% a year, although independent estimates place the number as high as 6.5×10108, or 6.5 quindecillion novemdecillion, percent.

Up to now, only vendors with licenses were legally able to accept foreign currencies, although the practice was widespread — private businesses altogether refuse to accept the unstable Zimbabwean dollar.

Large sections of the workforce, including teachers and doctors, have gone on strike because hyperinflation rapidly renders their wages worthless. Representative groups said salaries, now measured in trillions of dollars, are insufficient to pay for even the bus fare to work.

Zimbabwe also faces other crises, including a cholera epidemic that has claimed the lives of over 3,000 people, according to statistics from the World Health Organisation.

U.S. Senate approves revised bailout package after controversial additions

The U.S. Senate passed a revised bailout bill designed to help the struggling U.S. financial economy, which has measures nearly identical to the bill rejected by the U.S. House of Representatives on Monday.

“Senate Democrats and Republicans believe it is essential that we work quickly on this important legislation to restore confidence to our financial system and strengthen the economy,” said Senate Majority Leader Harry Reid.

The new revisions include raising the FDIC insurance cap to $250,000, a move designed to please progressives. However, the $110 billion in tax breaks, earmarks and what has been called pork barrel spending is not offset by any increases in revenues and has added opposition to the bill from some Representatives in the House.

Earmarks added into the bailout bill included $192 million in tax rebates for the Virgin Islands rum industry, $148 million in tax cuts for the wool industry, $100 million tax cuts to the auto racing industry, and $48 million in Hollywood tax incentives.

Vice President of Taxpayers for Common Sense, Steve Ellis, offered his explanation for the pork and earmarks added in. “People who support some of these provisions will forget about the $700 billion and concerns they may have on that, and say, ‘If you give me a few million in tax breaks for my constituents, I’ll go along'”.

The tactic seems to have worked, however, managing to flip enough votes to pass the bill.

“The inclusion of parity, tax extenders and the FDIC increases has caused me to reconsider my position,” said Representative Jim Ramstad (R Minnesota), who voted against the previous bill on Monday. “All three additions have greatly improved the bill.”

But Representative Marcy Kaptur (D Ohio) was not changing her no vote. “I will not support this legislation because it’s the wrong medicine,” she said.

The Senate took H.R.1424, a bill originating in the House concerning “equity in the provision of mental health and substance-related disorder benefits under group health plans, to prohibit discrimination on the basis of genetic information with respect to health insurance and employment,” and extended it with the bailout provisions.

H.R.1424 was introduced on March 9, 2007, by Rep. Patrick Kennedy (RI-1) and had the support of First Lady Rosalind Carter. It is noted on the Congressional Website that “On 10/1/2008, the Senate passed H.R.1424 as the vehicle for the economic rescue legislation. In the EAS version of the bill (Engrossed Amendment as Agreed to by the Senate), Division A (pp.1-110) is referred to as the Emergency Economic Stabilization Act of 2008; Division B (pp. 110-255) is referred to as the Energy Improvement and Extension Act of 2008; and Division C (pp. 255-441) is referred to as the Tax Extenders and Alternative Minimum Tax Relief Act of 2008.” It was not treated as an appropriations bill in the House.

There were two votes in the Senate. The first was to amend H.R.1424, which required 3/5 to be accepted, which it was. The second was a vote on the bill. Passage of the Bill required only a 1/2 majority. It was passed with 74 yeas and 25 nays. Senator Kennedy did not vote.

Wikinews has confirmed through several sources that a lawsuit filed against the Wikimedia Foundation, the parent organization of the popular online encyclopedia Wikipedia, by the ‘Barbara Bauer Literacy Agency,’ has been dismissed. As a result of the associated conflict, edits pertaining to Bauer on Wikipedia were deleted and, following the commencement of legal proceedings, Wikinews exclusively obtained the offending texts and edits.

Judge Jamie S. Perri dismissed the case citing the 1996 Communications Decency Act, promoting free speech over the Internet. The act protects the provider of interactive computer services from liability for publishing content provided by another.

At the start of the court action, Wikimedia asked the court to dismiss the case. “Wikimedia asks the Court to dismiss the claims against it, with prejudice. The claims against Wikimedia are frivolous because they are barred as a matter of law by the Communications Decency Act (47 U.S.C. § 230( c), “Section 230” or the “CDA”), by the First Amendment, and by New Jersey law. Wikipedia is an online encyclopedia written by its users, the content of which can be created, edited, or removed by anyone.

The claims arise from statements made on numerous Internet websites, which Plaintiffs assert describe them as being among the “20 Worst Literary Agents” and having “no…significant track record of sales to commercial (advance paying) published” states the motion filed in Superior Court of New Jersey, Monmouth County,” said the organization.

Before the case started, the Electronic Frontier Foundation (EFF) issued a press release that defends against a suit Bauer filed against Wikimedia which states that contributors on Wikipedia posted “libel statements” against Bauer that labeled her as number three on a list of twenty people grouped as the “worst” publishing agents, and included allegations that she had “no documented sales” through her firm. Complaints filed against her and her firm state that Bauer had a bad record when dealing with “commercial publishers,”, and questioning her practice of, “charge[ing] in advance of making a sale, against the generally-accepted industry practice.”

In March of 2007, Wikimedia was named in a lawsuit filed in Superior Court of Monmouth, New Jersey, along with 20 other defendants which included operators of the Absolute Write web site and the Science Fiction and Fantasy Writers of America who authored the list.

Wikinews has learned that Bauer’s Wikipedia article was deleted some time during the course of the proceedings, along with the edit history of her article and its talk page as a “courtesy.” During the investigation, Wikinews found that all edits to her article, and edits to pages requesting it to be deleted were deleted by Wikipedia administrator MaxSem.

Wikinews has also exclusively obtained all the edits affiliated with Bauer’s article, which was sourced accurately, the deletion requests along with the edit history of all pages related to the discussion about Bauer’s article. Fearing retribution on Wikipedia by other administrators and users, the source who provided Wikinews with the edit information wishes to remain anonymous.

The deleted Wikipedia article on Bauer stated that she claims “to have placed books with a number of well-known commercial publishers, but does not provide specific details of the books in question. In 2006, due to the number of complaints they receive, Writer Beware (part of the Science Fiction and Fantasy Writers of America writers’ organization) listed Bauer’s agency as one of the twenty worst literary agencies.”

Bauer’s article was started on May 25, 2006 but was not deleted until March 21, 2008 by Wikipedia administrator and Wikimedia office employee Cary Bass, who was not able to comment on the incident. It underwent two requests to be deleted, with the second one passing, and it was subsequently deleted. It had first been deleted on March 25, 2007 by “Doc Glasgow”, an administrator, amid allegations that the information presented in the article was “a bloody disgrace, full of ‘allegations of who said what on message boards. No mainstream media interest.” It was later restored on March 26 to undergo a “deletion review.” It was then deleted just under one year later after an extensive discussion.

Barbara Bauer was shown to have threatened a number of website hosts who reproduced the “Top 20 Worst Agents” list, or referred to her inclusion in the list; her complaints apparently prompted a brief takedown of the AbsoluteWrite.com site.

One blog even states that Bauer attempted to get people fired from their jobs, after allegedly posting information online that was in any way connected to the Top 20 worst agents.

“Barbara Bauer has been running around the Internet lately threatening people who’ve posted information about her fee-charging, non-manuscript-selling ways, including people who’ve linked to the Twenty Worst list. She has threatened legal action; she has even attempted to get people fired,” states Victoria Strauss on accrispin.blogspot.com.

The EFF, along with attorneys at Sheppard Mullin Richter & Hampton, are defending Wikimedia submitting a motion to dismiss the suit against the Foundation. The Foundation says that the First Amendment of the United States Bill of Rights and New Jersey law protect the contributors from any legal action.

Specifically, Section 230 of the act states, “no provider or user of an interactive computer service shall be treated as the publisher or speaker of any information provided by another information content provider. No provider or user of an interactive computer service shall be held liable on account of any action voluntarily taken in good faith to restrict access to or availability of material that the provider or user considers to be obscene, lewd, lascivious, filthy, excessively violent, harassing, or otherwise objectionable, whether or not such material is constitutionally protected.”

Bauer claims that her agency informed Wikimedia of the false allegations, and requested that they be removed. She also claimed that Wikimedia refused to remove the information when requested. Bauer further states that the contributors involved with her Wikipedia article “conspired to defame Plaintiffs and interfere with their prospective economic advantage.”

Mike Godwin, attorney for the Foundation states that the point of Wikipedia is to return the knowledge it provides, to a worldwide culture.

“We provide a platform through Wikipedia for smart citizens to give their knowledge back to a larger culture. Our ability to offer citizens that platform is what’s at stake in this case,” said attorney representing the Foundation, Mike Godwin in a EFF press release on May 2, 2008.

Despite the claim of freedom of speech, Wikinews has learned that on the same day, Godwin requested that the edits and the article on Wikipedia relating to Bauer, be deleted by a community action. Godwin also stated that the Foundation has “filed court papers in which we stated that the article is no longer available.”

“I’ve been trying to keep ‘Office actions’ to a minimum (partly in reaction to some fairly heavy-handed WP:OFFICE stuff in the past), and it would be helpful to be able to say that any given action was taken by the community, not by the Foundation,” said Godwin on Wikipedia’s Administrators’ noticeboard on May 2, the same day of the EFF’s press release. ‘Office actions’ are changes directly authorized by the Foundation which are made to content on any of the Wikimedia projects. The edits are made by staff members working for the Foundation’s head office located in San Francisco, California. Edits of this nature are generally “removals of questionable or illegal Wikimedia content following complaints,” according to Wikipedia’s policy on ‘Office Actions.’

A few minutes after, MaxSem, a Wikipedia administrator, deleted the edits related to the deletion request of Bauer’s article as a “courtesy” stating that there would be “legal problems” if the edits were not deleted.

Wikinews originally intended to publish an article at the start of the court case, although it was deleted from the article by Wikinews administrator Brian McNeil, who said that it was deleted “per consultation with Mike Godwin” as the posting of any material relating to Bauer, on Wikimedia sites, could be considered contempt of court. The deleted copy of this article was then leaked to Wikileaks, who released a press release saying that the Wikimedia Foundation censored Wikinews. At the time of this The Register reported that “Wikinews – like its sister site, Wikipedia – bills itself as a place without bias. Ostensibly, it’s a democratic news source that never answers to a higher power. But that’s just a setup for the latest act in the world’s greatest online farce.” The Register has a long history of denigrating Wikimedia projects.

A former mailman who proposed to paint the town hall pink, turn the local town square into a nudist pool, and to plant a marijuana field in the local park has been elected to the Reus, Spain town council.

Ariel Santamaria promised to show up to the town’s council meetings dressed up as Elvis Presley if he was elected and kept his word at the town’s first meeting on Thursday.

Before being elected, Santamaria who is a member of the Reus Independent Coordination, had also promised the town’s 100,000 residents that he would install a GPS system at the police department that would allow officers to track people who are smoking marijuana and provide them with a light if they need one.

An unnamed media consultant who works for Santamaria set up a website for his campaign and followed Santamaria wherever he went, dressed as a pirate.
