European Commission to investigate anti-competitive allegations against Google

The European Union’s executive body, the European Commission, has started investigating web search giant Google over anti-trust allegations by price comparison service Foundem and French legal services website ejustice.fr. At stake are allegations that Google’s AdWords results are manipulated to prioritise certain advertisers.

The complainants allege price comparison sites receive a lower ‘quality score’, thus being knocked out of fully automated, unpaid-for results; or, being required to pay more for advertising through the search giant’s AdWords program. Google rejects Foundem’s allegations, arguing the majority of content on price comparison sites is duplicated from other sites, asserting Foundem “duplicates 79% of its website content from other sites, thus adding no value.” The company line is, “[w]e have consistently informed webmasters that our algorithms disadvantage duplicate sites”.

The European Commission has a history of carrying out anti-trust investigations involving technology companies. Microsoft was ordered to pay substantial penalties for ‘bundling’ Windows with their Media Player; and, within the EU, must distribute a version of Windows that does not have said bundled software. A similar battle was fought over the automatic inclusion of Internet Explorer with their operating systems.

Google has previously been the subject of anti-trust allegations and investigations. United States authorities blocked Google from buying Yahoo!, citing concerns over a near-monopoly in search; Google’s purchase of mobile advertising company AdMob was also subject to anti-trust scrutiny by the US prior to being allowed to go ahead.

India Railway Minister presents 2014-15 budget

On Tuesday, Indian Railway Minister D. V. Sadananda Gowda presented his first budget for Indian Railways.

The budget emphasized increased amenities for travelers, better safety, and timely completion of projects. There were no fare hikes announced as both passenger and freight fares had been increased last month. But, it was announced that fares will be revised twice a year to absorb fuel costs. Gowda criticized previous governments for announcing new projects and failing to complete them. He said projects will now be prioritized, such as decongesting major routes instead of announcing new ones. Gowda announced no major new projects, but announced 54 new trains. He also criticized the last government for driving the railways into a loss.

Gowda announced a bullet train between Mumbai and Ahmedabad; new semi-high speed trains in nine sectors connecting metros; and new measures towards improving cleanliness, food, and e-ticketing were announced. He said CCTVs will be installed in major stations to monitor cleanliness, and major stations will have food courts serving local cuisines and precooked food from reputable catering brands will be served on-board. The railways have faced complaints of substandard food in the past.

He announced the introduction of a new rail-flaw detection system to better investigate the causes of accidents. The budget allocated a significant sum to the construction of bridges at unmanned crossings, a major cause of rail-track deaths. He announced a new project to introduce automatic closing doors on mainline and suburban trains, and said wi-fi will be provided in larger stations and select trains. Workstations will be available for on-board use for a fee by Business travelers. The e-ticketing system will be extended from booking tickets to booking coaches and entire trains, and also retiring rooms in stations. Electric mobility carts will be provided to elderly and handicapped passengers at all major stations. Also, Railway Protection Force will recruit four thousand female constables and escorted carriages will be provided for women. A significant amount was announced for improving rail connectivity in north-east India.

Gowda emphasized use of public-private partnerships (PPPs) to fund future projects. He also said he will ask the Cabinet to approve foreign direct investment (FDI) in Indian Railways. Some stations are to be improved using PPPs. Manish R. Sharma, executive director of capital projects and infrastructure at PricewaterhouseCoopers, pointed out the budget didn’t contain any information on how the government intends to attract private investors. Deven Choksey, managing director at K. R. Choksey securities, said the government now seemed to be more inclined towards PPPs than before. India’s stock index SENSEX dropped and closed 2% below opening. Investors were observed selling shares in energy, infrastructure, and real estate sectors.

World’s biggest polluters won’t cut back on fossil fuel

Six of the world’s major polluters, who participated in this week’s Asia Pacific Partnership on Clean Development and Climate (AP6 or APPCDC), have launched a multi-million dollar fund to develop clean-energy, but stressed they will be heavily reliant on polluting fossil-fuels for generations to come.

Green groups, labelling the talks a sham, have condemned the climate talks which were held in Sydney, Australia as a “coal and nuclear pact” between the big polluters and fossil-fuel firms. Australian climate change observers have attacked the AP6 outcomes as grossly irresponsible, saying the Federal Government is willing to accept the reality of runaway climate change.

A communique released by the AP6 states: “We recognise that fossil fuels underpin our economies, and will be an enduring reality for our lifetimes and beyond” – the document said. Green groups say the pact has missed a vital opportunity to commit to renewable energy sources. They say the two-day meeting failed to make any serious commitments in combatting global warming.

Combined, the United States, China, Japan, India, South Korea and Australia, account for around half the globe’s greenhouse gases. The six countries set up the summit as an ulterior method of tackling global warming outside the Kyoto Protocol by, they say, focussing on “clean-energy technology.”

Nuclear Power, clean coal technologies, geosequestration and industry-driven environment funds were some of the proposals raised at the summit. Unlike the Kyoto Protocol the six nations have not set any targets to cut greenhouse gases.

Climate change observers have broadly criticised the AP6 as a waste of time. Australian Climate Institute’s Clive Hamilton says the meeting did little to cut greenhouse gas emissions. “I think really this conference is about trying to protect the long-term future of the coal industry,” he said. “If you look at the sort of business people who have a seat at the table at the conference in Sydney, they overwhelmingly represent the polluting industries rather than those that will at some time in the future replace them – the renewable energy and energy efficiency industries.”

CSIRO chief scientist Dr David Brockway says the technology required to reduce greenhouse emissions is not viable for industry.

“It has to be borne in mind that anything we are going to do to reduce greenhouse gas emissions and intensity from the Australian economy will come at a cost,” he said. “What we are doing at the moment is doing research to try and reduce the size of that additional cost. I would say in a five to 10 year timeframe a number of these technologies will become viable.”

An AP6 communique issued at the end of the conference said reductions in greenhouse gases must be achieved without hindering economic growth – “the partnership aims to mobilise domestic and foreign investment into clean and low-emission technology by fostering the best possible enabling environments,” it states. Some of the world’s big mining and energy firms attended the talks and pledged to improve efficiency.

Green groups, who were left out of the conference, say the talks were aimed at subverting Kyoto – which obligates some 40 developed countries to cut greenhouse emissions by 5 percent below 1990 levels during 2008-2012. “Basically, they haven’t agreed to do anything in terms of serious commitment,” said Monash University climate change expert Professor Amanda Lynch. The United States and Australia refuse to sign Kyoto claiming its mandatory greenhouse gas cuts would threaten economic growth.

Australian Prime Minister John Howard said, “experience has taught us that seeking arbitrary targets doesn’t result in achieving practical solutions to global climate change.” Mr Howard stressed the importance of maintaining economic growth to alleviate poverty, while cutting greenhouse emissions.

He said the summit had injected “an overdue dose of realism into the debate about climate change. We believe it is possible to tackle issues of greenhouse gas emissions and the challenge of climate change without reducing living standards,” he said. “The world will go on using fossil fuels for many years into the future because it’s more economic to do so. So therefore it’s elementary commonsense that you should try and make the use of fossil fuels more greenhouse gas sensitive, you should try and clean up the use of fossil fuel,” he said.

The World Wildlife Fund (WWF) have dismissed Mr Howard’s comments as misleading and irresponsible. The WWF’s chief executive Greg Bourne said, “in my whole business career, I have never seen a more misleading public statement as that… If the statements made today become a reality, this will lock us in to a four-degree rise in global average temperatures, when two-degrees is considered extremely dangerous,” he said. “There couldn’t be anything more irresponsible than to knowingly embark on a path towards massive increases in emissions and runaway global warming.”

The AP6 nations said in the final communique that the eight public/private partnership taskforces created at the conference, will draw up action plans by the middle of 2006 on issues including renewable energy, power generation, cleaner fossil fuels and coal mining.

Environmentalists said the Sydney pact was doomed to fail because it did not impose targets on its members which comprise nearly half of humanity. The New South Wales Nature Conservation Council said the group’s voluntary approach was a “licence for government and business to do nothing”. “Without any incentives or penalties there is no reason for industry to move away from burning polluting coal and oil,” said the council’s Cate Faehrmann.

The AP6 countries encompass: 49 per cent of world GDP; 48 per cent of the world energy consumption; 48 per cent of global greenhouse gas emissions; and 45 per cent of the world’s population.

Many scientists say global warming is melting glaciers, raising sea levels and will cause more intense storms, droughts and floods. Current levels of carbon dioxide and methane in the atmosphere are higher now than at any time in the past 650,000 years, research from Antarctic ice cores shows.

IMF approves US$1.13 billion loan to Pakistan

The International Monetary Fund (IMF) said yesterday that its board has approved a loan package worth US$1.13 billion to be granted to Pakistan.

The move came after the IMF reviewed Pakistan’s economic performance with a standby arrangment worth $11.3 billion aimed at improving the country’s balance of payments. According to a statement by the fund, disbursements have reached $7.27 billion from the plan.

The IMF described Pakistan’s economic situation as having improved in spite of “adverse security developments and a rapidly changing political environment”, although saying the economy was still vulnerable.

The board also noted that it would grant waivers for several performance criteria Pakistan did not meet, namely overrunning the budget deficit and surpassing State Bank of Pakistan borrowing limits.

Pakistan requested a bailout package two years ago from the IMF, as it was struggling with three-decade-high inflation rates; the country has also seen much violence from rebel groups, with bombings having killed over 3,200 people since July of 2007.

A short trailer for the movie Dark Floors, a horror starring Finnish theatrical hard rock band Lordi, has been released.

The film, set in a hospital, follows a group of people left trapped by a broken lift as they are attacked by monsters, and focuses heavily on one particular patient, a little autistic girl.

Dark Floors, acted in English by a largely Finnish cast, cost 4.2 million (approximately US$6 million) to make. It will make its full premiere in Finland on February 8, 2008, although advance screenings will begin this year.

Lordi recently attended the Cannes Film Festival to promote the movie, where the band’s lead vocalist and frontman described it as a “traditional modern horror” and promised “horrific scenes.”

An epic round sixteen contest between Argentina and Mexico was won by a work of genius from Maxi Rodriguez, Saturday.

Juan Sorin hit a cross-field pass to the midfield player at the top right edge of the Mexican box. Rodriguez jumped to receive the ball and, in the same moment, chested high the way it had come. He met the descending ball 25 yards out with a perfectly timed left-footed volley and the ball arrowed over Oswaldo Sanchez into the opposite corner of the net.

The evenness and excitement of the match might easily be overshadowed by the winning goal. Though the shot totals were not high – Argentina had five shots on target to Mexico’s three – the action was end to end.

Part of the reason for the excitement was while Mexico tried to keep a fast attacking pace Argentina attempted to slow the game down. There could have been more goals; both Argentina and Mexico defended well and had timely saves from their goalkeepers.

Mexico got off to the best possible start with a goal from a set-piece after five minutes. Pavel Pardo’s cross from the right touchline was flicked on by Mario Mendez and Rafael Marquez slid in to score on a half volley at the far post.

For Argentina the equalising goal five minutes later was the best possible response to going behind. A corner kick was swung in low to the near post; Hernan Crespo raised his foot, Jared Borgetti stuck out his neck and between them the ball sped past Sanchez.

The match had its moment of controversy. Just before half time the Argentine goalkeeper rolled a ball to Gabriel Heinze. Somehow his defender let it go past him to Mexican striker Jose Fonseca. Heinze lunged to bring Fonseca down. Massimo Busacca adjudged Roberto Ayala to be the last defender and spared Heinze the red card for the deliberate professional foul.

Goalkeepers at either end made match saving contributions in the second half. On 53 minutes Roberto Abbondanzieri saved a defensive a clearance that deflected off Borgetti six yards from goal. Five minutes later Javier Saviola was through on goal; he went high and hard with the shot but Sanchez stuck out a strong left palm and batted the ball away for a corner.

Lionel Messi and Carlos Tevez replaced Crespo and Saviola as Argentina sought to break the deadlock. A minute from time Tevez thought he was through on goal but Ricardo Osorio got back just in time and the game was destined for another 30 minutes and that special moment in extra time.

Argentina’s win meant they would play their quarter-final match in the Olympiastadion, Berlin, against the host nation Germany on June 30.

The San Diego, California suburb of Chula Vista has responded to the recent housing crisis with an aggressive blight control ordinance that compels lenders to maintain the appearance of vacant homes. As foreclosures increase both locally and throughout the United States, the one year old ordinance has become a model for other cities overwhelmed by the problem of abandoned homes that decay into neighborhood eyesores.

Chula Vista city code enforcement manager Doug Leeper told the San Diego Union Tribune that over 300 jurisdictions have contacted his office during the past year with inquiries about the city’s tough local ordinance. Coral Springs, Florida, and California towns Stockton, Santee, Riverside County, and Murietta have all modeled recently enacted anti-blight measures after Chula Vista’s. On Wednesday, 8 October, the Escondido City Council also voted to tighten local measures making lenders more accountable for maintenance of empty homes.

Lenders will respond when it costs them less to maintain the property than to ignore local agency requirements.

Under the Chula Vista ordinance lenders become legally responsible for upkeep as soon as a notice of mortgage default gets filed on a vacant dwelling, before actual ownership of the dwelling returns to the lender. Leeper regards that as “the cutting-edge part of our ordinance”. Chula Vista also requires prompt registration of vacant homes and applies stiff fines as high as US$1000 per day for failure to maintain a property. Since foreclosed properties are subject to frequent resale between mortgage brokers, city officials enforce the fines by sending notices to every name on title documents and placing a lien on the property, which prevents further resale until outstanding fines have been paid. In the year since the ordinance went into effect the city has applied $850,000 in fines and penalties, of which it has collected $200,000 to date. The city has collected an additional $77,000 in registration fees on vacant homes.

Jolie Houston, an attorney in San Jose, believes “Lenders will respond when it costs them less to maintain the property than to ignore local agency requirements.” Traditionally, local governments have resorted to addressing blight problems on abandoned properties with public funds, mowing overgrown lawns and performing other vital functions, then seeking repayment afterward. Chula Vista has moved that responsibility to an upfront obligation upon lenders.

That kind of measure will add additional costs to banks that have been hit really hard already and ultimately the cost will be transferred down to consumers and investors.

As one of the fastest growing cities in the United States during recent years, Chula Vista saw 22.6% growth between 2000 and 2006, which brought the city’s population from 173,556 in the 2000 census to an estimated 212,756, according to the U.S. Census Bureau. Chula Vista placed among the nation’s 20 fastest growing cities in 2004. A large proportion of local homes were purchased during the recent housing boom using creative financing options that purchasers did not understand were beyond their means. Average home prices in San Diego County declined by 25% in the last year, which is the steepest drop on record. Many homeowners in the region currently owe more than their homes are worth and confront rising balloon payment mortgages that they had expected to afford by refinancing new equity that either vanished or never materialized. In August 2008, Chula Vista’s eastern 91913 zip code had the highest home mortgage default rate in the county with 154 filings and 94 foreclosures, an increase of 154% over one year previously. Regionally, the county saw 1,979 foreclosures in August.

Professionals from the real estate and mortgage industries object to Chula Vista’s response to the crisis for the additional burdens it places on their struggling finances. Said San Diego real estate agent Marc Carpenter, “that kind of measure will add additional costs to banks that have been hit really hard already and ultimately the cost will be transferred down to consumers and investors.” Yet city councils in many communities have been under pressure to do something about increasing numbers of vacant properties. Concentrations of abandoned and neglected homes can attract vandals who hasten the decline of struggling neighborhoods. Jolie Houston explained that city officials “can’t fix the lending problem, but they can try to prevent neighborhoods from becoming blighted.”

CEO Robert Klein of Safeguard, a property management firm, told the Union Tribune that his industry is having difficulty adapting to the rapidly changing local ordinances. “Every day we discover a new ordinance coming out of somewhere”, he complained. Dustin Hobbs, a spokesman from the California Association of Mortgage Bankers agreed that uneven local ordinances are likely to increase the costs of lending. Hobbs advised that local legislation is unnecessary due to California State Senate Bill 1137, which was recently approved to address blight. Yet according to Houston, the statewide measure falls short because it fails to address upkeep needs during the months between the time when foreclosure begins and when the lender takes title.
