US Senate passes new bankruptcy bill

Saturday, March 12, 2005

In a vote of 74-25 last Thursday, the US Senate passed a measure that would change bankruptcy laws, making it harder for individuals seeking relief from their debt burden to avoid repayment. Almost twenty Democrats joined Republicans, who currently hold a majority of the seats in the US Senate, in passing the bill.

Lobbyists for credit card companies and financial services firms have worked for the bill during the last two administrations. A similar measure passed both the Senate and House during the previous administration, but then President Bill Clinton pocket-vetoed the measure in 2000.

Democrats sought to soften the bill by allowing bankruptcy filers to negotiate directly with lenders for relief, but the amendments were defeated by the Republican-controlled Senate. Proponents of the bill claim the rise of bankruptcy filings to nearly 1.5 million a year shows that abusers of credit use the filings to shield themselves from irresponsible practices.

“There has been an explosion of bankruptcy,” said Iowa Republican Sen. Charles E. Grassley, the bill’s sponsor. “We preserve the principle of a fresh start, but we also establish a principle that if you have the ability to repay some of your debt, you are not going to get off scot-free.” However, Massachusetts Democratic Sen., Edward M. Kennedy said, “This legislation makes the bankruptcy courts of the United States the collection agency for the credit-card industry.”

The bill impacts a broad spectrum of bankruptcy law, but the most significant impact is on personal bankruptcy filings. Individuals who get behind in repaying credit card debt face high interest charges and stiff late payment fees. By only meeting minimum payment requirements, borrowers remit to the lender over the life of the loan an amount in interest and other fees that can far exceed the value of the principal balance of the loan. This can put consumers who run up high balances on various cards at financial risk of default. Critics of the bill blame these aggressive lending practices as a contributing factor in the rising trend of bankruptcy filings from 1996.

The proposed bill doesn’t only affect debtors with credit card debt.

It also affects debtors who have run up large medical bills.

Patients with a past medical history that disqualifies them from full medical coverage, can easily find themselves facing insurmountable medical bills after just a short stay in the hospital. These individuals will no longer be able to get a fresh start after these personal disasters, and will be forced to live in poverty until they can pay off their medical bills as part of their Chapter 13 filing. (Prior to this bill, they would have been able to file Chapter 7, completely discharging their debt.)

Chapter 7, which accounts for 70% of bankruptcy filings, allows individuals to eliminate most non-secured debts after liquidating assets, with the notable exemption of one’s principle residence in most states. The Senate passed bill would change Chapter 7 eligibility by applying a means-test, where those with a median income higher than the state average would be required to file under Chapter 13 provisions. Under Chapter 13 protection, an individual’s debt is not forgiven; rather it is restructured for payment under more lenient terms.

This was the first major overhaul of federal bankruptcy law in many years.

Under the old bankruptcy law, a personal bankruptcy attorney could not be held financially responsible for his clients mendacity. Under the new bankruptcy law, the bankruptcy attorney is responsible for his client’s lies to the Court about his assets and the bankruptcy attorney and his insurance carrier can be held responsible by the Bankruptcy Court.

The result is that personal bankruptcy attorneys (this does not apply to corporate bankruptcy attorneys) are likely to flee the personal bankruptcy field when the new law takes effect. Their insurance companies will not offer the sort of coverage that they would need to continue to practice.

So when consumers need to file personal bankruptcy under the new law, they will be unlikely to find a bankruptcy attorney to represent them. Consumers will have to file pro se: such consumers will be likely to fail due to the complexity of the law.

The bottom line is that the field of personal bankruptcy law as a practice area of law will cease to exist when the new bankruptcy law takes effect, and consumers will be unable to secure legal counsel and so consumers will lose what legal protections counsel now affords them.

Under the new bankruptcy law about one half million Americans will be forest to pay for at lest 5 years on longer they will be held in servitude as chattel they will be completely subservient to a dominating influence of the company that holds the loan. Their loan will be put on the market for sale for profit. The people will be forced to work harder. People who fail to go to court will have a arrest warrant made out in their name and people who refuseto pay. They will be subject to fines and or jail. About fifty thousand Americans will punished by a fine and or about three thousand Americans every year will go to jail under the new bankruptcy law. For some people this will be a third strike they will be put in jail for life.

The bill has the support of President Bush, and its passage in the House sometime next month seems likely. If enacted into law, lending companies will recover more money on what otherwise would be written off as bad loans. Those persons of median and higher income seeking relief would be required to file under Chapter 13 status and pay up to $100 per month under court imposed conditions. It is expected the proposed changes would cause a sharp increase in filings before the new law could take effect.

Conservationists capture most massive Burmese python in Florida history

Saturday, June 25, 2022

Media reported Wednesday that biologists from the Conservancy of Southwest Florida reported having captured a Burmese python (Python bivittatus) measuring nearly 18 feet (5 m) in length and 215 pounds (97 kg) in weight in the state’s Everglades wetlands.

It may be the largest member of its species ever found outside its natural range in Southeast Asia. Another Burmese python measuring 18 feet and 9 inches (5.7 m) was found in 2020, but it only weighed 104 pounds (47.2 kilograms).

In a search documented by National Geographic, the team captured the current snake in December 2021 by tagging a male “scout snake” named Dionysius with a GPS tracking device and releasing it into the western Everglades.

“How do you find the needle in the haystack? You could use a magnet, and in a similar way our male scout snakes are attracted to the biggest females around,” said wildlife expert Ian Bartoszek, the team’s project manager.

Pythons are an invasive species in Florida. Removing female snakes from the environment before they lay their eggs is the Conservancy’s preferred strategy for limiting python breeding. When the team saw that Dionysius was spending several weeks in one area, they concluded he’d found a sexually mature female and set off to retrieve him.

It took twenty minutes of wrestling and three adult humans to carry the snake to a vehicle, in which it was taken to a laboratory in Naples, Florida and euthanized. Upon necropsy, it was found to contain over 122 healthy but unfertilized egg follicles.

Pythons were introduced to Florida in the 1970s, probably by being sold as pets. While there is a history of individual pet owners illegally releasing exotic animals into the wild after they grow larger than expected, the destruction caused by Hurricane Andrew in 1992 also allowed animals from a serpent center to escape to the Everglades and other habitats, where they reproduced in great numbers.

Since then, they have disrupted the food chain by eating local animals, including endangered animals: the stomach of this snake contained the remains of a white-tailed deer.

The state of Florida considers Burmese pythons a threat to native wildlife and sponsors an annual python hunt with USD2,500 as first prize.

Cupid: The Figure Of Love

By Julia Tanner

Cupid is the goddess of love. His counter part in Geek mythology was Eros the god of love. He is best known as the handsome young god who falls in love with the beautiful maiden psyche. The story is told in the Golden Ass, as a romance by the roman writer Lucius Apuleius. In other tales he appears as a mischievous boy who indiscriminately wounds both gods and humans with his arrows, thereby causing them to fall deeply in love. Cupid is most commonly represented in art as naked, winged infant, often blindfolded, carrying a bow and a quiver of arrows.

According to the myth narrated by the Roman writer Apuleius in the Golden Ass, the beautiful Psyche, who was loved by Cupid, the god of love, was given immortality bu Zeus.

Psyche in the Roman mythology, is a beautiful princess loved by Cupid, god of love. Jealous of Psyche’s beauty, Venus the goddess of love, ordered her son, Cupid, to make Psyche fall in love with the ugliest man in the world. Fortunately for Psyche, Cupid instead fell in love with her and carried her off to a secluded palace where he visited her only by night, unseen and unrecognized by her. Although Cupid had forbidden her to look upon his face, one night Psyche lit a lamp and looked upon him while he slept. Because he had disobeyed him, Cupid abandoned her, and Psyche was left to wander desolately throughout the world in search for him. Finally after many trials was reunited with Cupid and was made immortal by Jupiter, the king of gods.

Cupid, Roman God of Love and perhaps the most famous of all Valentine symbols, has always played a role in the celebration of romance. As the son of Venus, he is often depicted as a mischievous, winged child whose arrows pierce the hearts of his victims, causing them to fall in love. Cupid is derived from the Latin word cupido, which means “desire.” His Greek counterpart is Eros (from whom comes the word “erotic”), young son of Aphrodite, Goddess of Love and Beauty, and Ares, God of War. In Greek mythology, Eros has a brother named Anteros, sometimes represented as the Avenger of Slighted Love and sometimes depicted as the symbol of Reciprocal Affection.

According to legend, Cupid’s arrows come in two varieties: the Golden Arrow, which generally signifies true love, and the Leaden Arrow, which represents wanton and sensual passion. He is also known to sometimes carry a torch with which to inflame desire between men and women. Cupid is not always successful in his endeavors, however. Sometimes his arrows turn people away from those who fall in love with them. In some mythological tales, Venus was scratched by one of Cupid’s arrows while playing with her son, the result being that the Goddess fell instantly in love with Adonis…the first man she saw after receiving the wound.

According to some sources, Cupid (as Eros) arose out of Chaos, along with Tartarus and Earth (making him one of the oldest Gods), only later becoming associated with Aphrodite as her winged son. The mingling of Eros (who, in this instance, was considered to have no parents) with Chaos is said to have created the race of birds. In certain mythological tales, it is stated that there was no race of immortals before Eros caused all things to mingle. Other legends maintain that Eros hatched from an egg laid by Nyx, also known as Night. Cherubs are also believed to be descendants of Cupid. Depicted as lovable little winged creatures devoid of either arrows or quivers, cherubs are typically not mischievous, as is their infamous alleged ancestor.

ANZACs remembered ninety years after assault on Gallipoli

Monday, April 25, 2005

Australians and New Zealanders throughout the world stood still for their national war memorial days in remembrance of the failed Australian and New Zealand Army Corps — ANZAC — attack on Gallipoli, Turkey that began on 25 April 1915. The fateful attack was designed to end the First World War more quickly by creating a supply line to Russia. A hundred-thousand died in the battle, remembered every year as ANZAC Day by both nations.

The British-directed battle of Gallipoli is often seen as the defining moment in the ‘birth’ of Australia and New Zealand. With New Zealand Prime Minister Helen Clark saying “For New Zealand as for Australia it was at Gallipoli that our young nations came of age.” [1]. This being the 90th anniversary of the attack, Clark, Australian Prime Minister John Howard and Britain’s Prince Charles are all at Gallipoli to remember that fateful campaign.

Some controversy has been created about Australian Prime Minister John Howard not attending the New Zealand ceremony at Chunuk Bair on the Gallipoli Peninsula. This has upset many people as it is a break in a tradition that the Prime Ministers attend the ceremonies of both countries.

Wikinews interviews Australian Paralympic skier Andrew Bor

Tuesday, December 11, 2012

Sunday, Wikinews sat down with Australian Paralympic guide skier Andrew Bor who was participating in a national team training camp in Vail, Colorado.

((Wikinews)) This is Andrew Bor, who is Melissa Perrine’s guide skier. How did you become a guide?

Andrew Bor: I was coaching with the team, the September before the games here. And the APC [Australian Paralympic Committee] found out, I’m not sure how, sent Melissa out to New Zealand where there was a training camp. She didn’t have a guide. And one of the coaches chose me to guide Mel.

((WN)) Had you done much guiding before?

Andrew Bor: Two days. Guided a visually impaired athlete twice before that.

((WN)) Was there a steep learning curve?

Andrew Bor: Yeah, very steep learning curve. Still learning.

((WN)) Is it more difficult as a male guide with a female skier, do you think, because the rules require you to use male ski equipment?

Andrew Bor: No. No, I don’t think so. I don’t think there’s any issue with that. The skis make a different radius turn. Sometimes. No, I don’t think it makes a huge difference.

((WN)) As a guide skier, do you think that guides should be getting medals when their skier gets a medal? Are you that important?

Andrew Bor: No, I don’t know. It’s the athlete’s performance really.

((WN)) But you’re an athlete aren’t you?

Andrew Bor: No. I’m their eyes if that makes any sense. If they don’t have the commitment to go down the hill, you’re never going to get them to go fast anyway. The guide’s responsibility is to put them in the right place. But beyond that…

((WN)) You’ve gotten support because of the performance in Vancouver? The government has been supporting you guys?

Andrew Bor: The government has decided to support the guides as equally as the athletes. Before I was employed by the APC, and now I don’t get paid by the APC, I get the same support levels. Otherwise, you can’t do it, you can’t afford the time.

((WN)) Why have you chosen skiing as opposed to oh, waterskiing or some other sport?

Andrew Bor: I’ve worked in this industry for about 20 years. Teaching skiing, coaching. It’s not something I chose to do, it’s something that kind of happened. After a while a door closed, a door opened. I enjoy the environment. Working outdoors and work in some lovely places. You get some great days when there’s blue sky and sunshine and other days in Australia where it might be two degrees and raining. But it beats working in an office.

((WN)) Do you think the classification system for blind skiers works and is a good one? Especially with the factoring issues, and you’re competing with B1, B2, B3, all compete against each other.

Andrew Bor: Yeah, I don’t know. I don’t think there’s a big enough pool of athletes to have three different classes. It’s never going to be ideal. Different classes have different issues. The handicap for the twos and the threes is fairly similar across the different disciplines. Maybe the threes have an advantage in the tech because they can see a bit more, but they have a bit of a disadvantage in the speed because they can’t see enough to see the next gate and have to rely on the guide. Bit of a trade off. It’s never going to be perfect. It’s a tough one.

((WN)) Are you planning to go to Sochi with Melissa?

Andrew Bor: Yes. Yes I am.

((WN)) Do you think you guys have, you and Melissa can pick up a medal, and you get a medal?

Andrew Bor: I think Melissa is yeah. I think Melissa has a fairly good chance. You know, if things fall in place. I think she’s got an opportunity to win at least a medal. If things don’t fall in place. Yeah. She might miss out completely.

((WN)) Do you plan to continue guide skiing with Melissa for a period following Sochi, or are you going to be like “I’ve had enough, I’m getting old, these mountains are really tall, I’m going to retire?”

Andrew Bor: I don’t know. We’ll wait and see. At the moment the commitment is until Sochi. You see with athletes, some announce their retirement early. Depends what Melissa wants to do. Depends on whether you achieve the goals that she sets or not. Whether she’s got unfinished business…

((WN)) But at the moment, the goal is Sochi?

Andrew Bor: The goal is Sochi, yes. You’ve got to have an end goal, and at the moment it’s Sochi. The energy of the last four years has been put into that. There’s been a commitment for her to go to Sochi, and at the same time you’ve got to commit to the same thing. The guide-to-athlete thing is a relationship that takes time to build and work out the needs of the athlete and the wants of the athlete. Beyond Sochi, don’t know. We’ll see.

U.S. manufacturer General Motors seeks bankruptcy protection

U.S. manufacturer General Motors seeks bankruptcy protection
Posted by Admin , No Comments

Monday, June 1, 2009

United States automobile manufacturing firm General Motors filed for bankruptcy and Chapter 11 protection from its creditors at 12:00 UTC Monday, in a Manhattan, New York federal bankruptcy court. This was the largest bankruptcy filing for a U.S. manufacturing company, and with declared assets of $82.29 billion and a debt of $172.81 billion, and the fourth largest bankruptcy filing in recent U.S. history — after the bankruptcies of {{w|Lehman Brothers|| ($691.06 billion), Washington Mutual ($327.91 billion), and WorldCom ($103.91 billion).

The filing, expected to be the first of many, was for a New York GM affiliate, Chevrolet-Saturn of Harlem Incorporated. Numbered 09-50026, it named GM as a debtor in possession, and was filed before judge Robert Gerber.

GM is to be represented throughout the filing process by Weil Gotshal & Manges, a New York law firm specializing in bankruptcy.

The chief restructuring officer, named in the filing, is to be Al Koch, a managing director at AlixPartners LLP in New York, who will report directly to Fritz Henderson, the Chief Executive Officer of General Motors.

In its bankruptcy petition, GM listed its primary creditors as:

Name Amount owed (USD millions)
Wilmington Trust 22,000
United Auto Workers union (UAW) 20,560
Deutsche Bank 4,440

The amount owed to UAW excludes “approximately $9.4 billion corresponding to the GM Internal VEBA”. USD22,760 millions are owed to bondholders.

Analysts have observed that the effect of the bankruptcy filing on the U.S. economy is not expected to be as major as it once would have been. One such voice, Mark Zandy, an economist at Moody’s Economy.com, commented that “Bankruptcy now is irrelevant in terms of the economic consequence of what’s happening to GM.” Such analysts believe that the economic impact of GM’s problems has already been felt, with its effects on parts suppliers and employment. They also believe that GM’s programme of accelerated payments, and its participation in a U.S. Treasury program to ensure prompt payments to parts manufacturers, will have cushioned the effect of the bankruptcy itself.

Speaking on Bloomberg Radio, David Cole, chairman of the Center for Automotive Research in Ann Arbor, stated that the fragility of the parts suppliers, the loss of whom would threaten the entire automobile manufacturing industry, was of more immediate concern than the GM bankruptcy.

Also filing for chapter 11 protection today were Saturn LLC and Saturn Distribution Corporation, subsidiary companies of General Motors.

As a consequence of the bankruptcy, General Motors Corporation (GM.N) was removed from the Dow Jones Industrial Average, and was replaced by Cisco Systems (CSCO.O), these changes scheduled by Dow Jones & Company to take effect from the opening of trading on June 8.

Before a full house at a game that was the first one to sell out in the lead up to the start of the London Paralympics, the United States national wheelchair rugby team defeated Great Britain national wheelchair rugby team by a score of 56–44. While the game got off to a slow start for the United States, once the team found its rhythm, they dominated the home team and appeared to score at will. Despite this, the crowd supported their side, even when they were down by eight points. When the United States bench started a chant of U-S-A! U-S-A!, the crowd soon drowned them out with a chant of Team G-B! Team G-B!

The United States came to London as defending gold medalists and ranked first in the world. Coming into the game, the team’s assistant coach James Mate told the media regarding this game, “To be truthful we have played the home team a couple of times, but you have to play the game in that moment and it can give the hosts the edge. […] In Beijing, Great Britain gave us our best game, and the semifinal was a three-goal game. We had something similar in June (at the Canada Cup). […] They (Great Britain) play some like us and some like Canada, and are one of the teams that have a lot of good players, so we can’t focus on just one player, but on the team as a whole.”

Ranked sixth in the world, Great Britain came to London as the home town favorites. Their roster included club players from across the country including David Anthony who plays for the Cardiff Pirates, Andy Barrow, Bulbul Hussain and Steve Brown who play for the Kent Crusaders, Jonathan Coggan and Mandip Sehmi who play for the Stoke Mandeville Storm, Mike Kerr who plays for the North West Bulls, Myles Pearson who plays for the West Coast Crash, and the team’s only female player Kylie Grimes who plays for the London Wheelchair Rugby Club with teammate Ross Morrison.

Before the game, first time Paralympian Great Britain wheelchair rugby player Mike Kerr told the media regarding his squad selection, “I felt I’d never been given a chance to get noticed, so I got myself some court time at big tournaments like Knock and Roll in 2010 (a USA national tournament) and Bernd Best (the biggest wheelchair rugby tournament in the world, held in Germany). I played well and I think people finally took notice.” Regarding the wait to play, Kerr said, “It’s hard. I hate waiting around. I’m here to do a job and the sooner I get started the better. But it’s been a great experience so far. The crowd and support have been amazing. […] I’m really confident. We took confidence from how we played against them at the Canada Cup (in June). If we play our game we can shock them.”

The United States meets Japan while Great Britain meets France later today in their second games in pool play.

In the second wheelchair rugby match of the London Paralympics, Sweden defeated Belgium by a score of 52–42.

Sweden, the current European champions, came to London with a relatively new coach, who only took over the side in late 2011. Belgium’s coach Bob Vanacker also plays on the team. He and Peter Genyn and Lars Mertens play their club wheelchair rugby in the United States.

In the first game for both teams since the London Paralympics began, Australia national wheelchair rugby team defeated Canada by a score of 64–52. Australia and Canada both had their flag bearers from the opening ceremonies represented by this sport, Greg Smith for Australia and Garett Hickling for Canada.

Beijing silver medalists Australia came to London ranked second in the world. Their last major competition before the Paralympics was the Canada Cup, where they lost to the United States by a single point. The Australian side included flag-bearer Greg Smith at his fifth games, Nazim Erdem who is at his third Paralympics, Ryley Batt and Ryan Cott who competed at the 2004 and 2008 Games, Cameron Carr who competed at the Beijing Games, Chris Bond, Cody Meakin, Ben Newton, Andrew Harrison, Josh Hose and Jason Lees who made their Paralympic Games debut.

Canada came into their match against Australia as returning bronze medalists. Their roster included Ian Chan who was on the team that finished first at the 2002 World Championships, the former ice hockey player Jason Crone from Owen Sound, Ontario, debut Paralympian from Embrun, Ontario Oarice Dagenais, 2002 World Champion Jared Funk from Manitoba, five time Paralympian Garett Hickling, Trevor Hirschfield who is decribed by the Canadian Paralympic Committee as one of the world’s best low point players, Athens silver medalist and Beijing bronze medalists Fabien Lavoie, eighteen-year-old Zak Madell, University of Arizona alumnist Travis Murao, 2010 World Championships All Star Ten player Patrice Simard, former recreational hockey player David Willsie and Harrow, Ontario native Mike Whitehead.

Australia meets Sweden later today while Canada will take on Belgium.

In the last match of day yesterday, Japan defeated France 65–56. France qualified for the tournament despite the national team only being five years old. Japan came to London having beaten the top ranked United States in this year’s Canada Cup.
