Wikinews discusses DRM and DMCA with Richard Stallman after GitHub re-enables public access to youtube-dl
This article mentions the Wikimedia Foundation, one of its projects, or people related to it. Wikinews is a project of the Wikimedia Foundation.

Tuesday, November 17, 2020

On November 16, code-sharing and hosting service GitHub re-enabled the public access to youtube-dl repository, a software which can download videos from the internet via the command-line. This move comes after Mitchell Stoltz, a Senior Staff Attorney of the Electronic Frontier Foundation (EFF), sent a letter to GitHub on the behalf of youtube-dl’s maintainers. The repository was previously blocked on October 23, after GitHub received a Digital Millennium Copyright Act (DMCA) take-down notice from the Recording Industry Association of America (RIAA).

Started in July 2008, youtube-dl is a free/libré open source software written in Python which can download videos from various websites. Citing alleged violation of 17 U.S. Code § 1201 Circumvention of copyright protection systems, RIAA’s takedown notice had alleged youtube-dl was intended to circumvent the technological protection measures of streaming services and to redistribute music videos without authorisation. youtube-dl’s source code had a number of unit tests to check if the software works in different circumstances or not. Some of the test cases included URLs of some copyrighted songs.

In the letter to GitHub, EFF’s attorney Stoltz said “This file contains series of automated tests that verify the functionality of youtube-dl for streaming various types of video. The youtube-dl source code does not, of course, contain copies of these songs or any others […] the unit tests do not cause a permanent download or distribution of the songs they reference; they merely stream a few seconds of each song to verify the operation of youtube-dl. Streaming a small portion of a song in a non-permanent fashion to test the operation of an independently created software program is a fair use.” The letter stressed “youtube-dl does not decrypt video streams that are encrypted with commercial DRM technologies”.

The URLs to copyrighted songs were removed from the source code on November 16, and replaced with a test video that uploaded on YouTube by Philipp Hagemeister, former maintainer of youtube-dl. Philipp Hagemeister had previously spoken about the takedown with Wikinews.

youtube-dl comes with a small JavaScript interpreter where it acts as a web-browser would behave while receiving video data from the server. The script has “extractors” for various websites to handle videos from different sources. “Any software capable of running JavaScript code can derive the URL of the video stream and access the stream, regardless of whether the software has been approved by YouTube”, the letter read. It borrowed an analogy of Doors of Durin from J. R. R. Tolkien’s Lord of the Rings for explanation: travelers come upon a door that has writing in a foreign language. When translated, the writing says “say ‘friend’ and enter.” The travelers say “friend” and the door opens. As with the writing on that door, YouTube presents instructions on accessing video streams to everyone who comes asking for it.

Hours after the public access was restored, Sergey M, one of the maintainers of youtube-dl wrote on GitHub, “We would like to thank @github for standing up for youtube-dl and making it possible to continue development without dropping any features. We appreciate [GitHub] for taking potential legal risks in this regard. We would also like to thank [EFF] and personally [Mitch Stoltz] for invaluable legal help. We would also like to heartily thank our main website hoster Uberspace who is currently being sued in Germany for hosting our essentially business card website and who have already spent thousands of Euros in their legal defense.”

Hours after GitHub restored the public access to the repository, Stoltz tweeted “I think of youtube-dl as a successor to the videocassette recorder. The VCR empowered people to take control of their personal use of free-to-air video, but it had to be saved from the copyright cartel. The same goes for youtube-dl. GitHub did the right thing here.”

youtube-dl is used by thousands of people around the world. Multiple Creative Commons-licensed and public domain videos on Wikimedia Commons are uploaded via a tool called video2commons, which relies on youtube-dl to download media. youtube-dl also lets users download videos from LiveLeak — a video-sharing platform for citizen journalism. Videos downloaded using youtube-dl are also used for the purpose of fair use, or for evidence. When a copyright holder chooses to release their work, be it a photograph, a video, or audio, under a Creative Commons Attribution (CC BY) license, they allow everyone to freely own, share or modify the work as long as the reusers properly attribute the author of the work. YouTube also hosts many audio and video recordings in the public domain which can be used for any purpose without any restrictions.

In the blog post announcing “youtube-dl is back”, GitHub said, “Although we did initially take the project down, we understand that just because code can be used to access copyrighted works doesn’t mean it can’t also be used to access works in non-infringing ways. We also understood that this project’s code has many legitimate purposes, including changing playback speeds for accessibility, preserving evidence in the fight for human rights, aiding journalists in fact-checking, and downloading Creative Commons-licensed or public domain videos.”

GitHub also announced any new 1201 takedown notices will be “carefully scrutinised by legal experts” to reject “unwarranted claims”, and said it will side with software developers if the claims are ambiguous. The announcement also mentioned GitHub Trust and Safety team would treat developer’s tickets as a “top priority”. GitHub also pledged donation of USD 1 million for developer defense fund “to help protect open source developers on GitHub from unwarranted DMCA Section 1201 takedown claims”.

GitHub had blocked public access to many forks of youtube-dl upon receiving the DMCA notice in October. Wikinews notes public access is not yet restored for the forked repositories listed in RIAA’s copyright notice and still displays “Repository unavailable due to DMCA takedown”.

During the period when GitHub had disabled public access for the repository, Sergey M had been developing youtube-dl and hosting it on GitLab, another code-sharing and hosting site. However, since GitHub has restored public access of youtube-dl, Sergey M has made the GitLab repository private.

After this, Wikinews reached out to Richard Stallman, the founder of Free Software Foundation, who has been highly critical of DRM (digital rights management, the subject of the DMCA) for many years now, to discuss the harms of DRM and DMCA 1201.

Commercial Uses Of GPS Trackers

by

kimkm

As GPS tracking systems are becoming increasingly popular and a part of our everyday lives, we become more and more guaranteed of the usefulness of this system s domestic usage. From personal safety to navigation, and from vehicle location to speed monitoring, the GPS tracking systems prove their worth every day.

However, we also see that not many people are aware of a how a GPS tracker can be used commercially, and how a great number of businesses can increase their profits and productivity with the help of a GPS tracking system.

An industrialist country, like United States, uses transportation, logistics and fleet/freight management as the engine of its trade and commerce. A lot of big and small businesses are involved in this part of the industry and help transport goods and services all around the United States, satisfying millions of consumers every day.

[youtube]http://www.youtube.com/watch?v=qxoLE2rX078[/youtube]

If you are also running a similar business, here s how a GPS tracking system can make your business more productive, and your costs more reduced.

If you install a GPS system in your commercial vehicles, you are a in an effective position to manage the routes more efficiently. You can inform the driver in advance if a road is blocked ahead, thus saving precious time and fuel. You can also sit down with your drivers and create new routes that can save time, are more secure and thus process deliveries more quickly.

The GPS system is also great in tracking the amount of time the vehicle took to travel from point A to point B, if any stops were made, the speed that was maintained or fluctuated, and the routes the vehicle travelled and the roads that were passed. Having this information available can help you implement driver accountability, thus making the business more productive.

Another great advantage of a GPS system is that you can keep an eye on the speed at which the driver is driving. You can not only inform the driver in time to avoid any speed-limit crosses but can also use this information to fuel costs.

It is also a great system because it helps you communicate accurate responses to the queries of your consumers. If they want to know how much a delivery would take, you are in a great position to determine that information by pin-pointing the current location of the vehicle and determining remaining distance and other information etc. It also helps you inform your customer of any delays that are going to occur.

Another great thing about GPS trackers is that they also inform you about your vehicles state of maintenance. It helps you keep a record on when was the last time a vehicle was sent for maintenance, and when it is next due. It helps you ensure that your whole fleet will remain in a spank and clean condition always, which can result in longer vehicle life.

With all these great advantages to GPS trackers available, there is no reason why you should not go and get your fleet installed with a GPS tracking system. It will also help you save on insurance.

Kentucky Derby winner Barbaro injured in Preakness, does not finish race

Saturday, May 20, 2006

Kentucky Derby winner Barbaro, sent as the post-time odds-on favorite in this year’s Preakness Stakes at Pimlico Race Course in Baltimore, Maryland, breaks down in the opening stretch of the race, shattering any chance of a Triple Crown winner this year. Bernardini, the 12-1 4th choice out of 9, ends up winning this year’s Preakness, stopping the clock at 1:54.65. Following up 5 1/4 lengths behind was Sweetnorthernsaint, sent to the post at 8-1, and Hemingway’s Key at 29-1, six lengths further back.

According to Dr. Larry Bramlage, the on-call veterinarian for the American Association of Equine Practitioners, Barbaro’s injury was “significant” and “would require major stabilizing surgery.” Barbaro’s injury effectively ended the horse’s racing career.

Bernardini, a colt by A.P. Indy out of Cara Rafaela, by Quiet American, was bred and is owned by the Darley Stable of Sheikh Mohammed, is trained by Tom Albertrani, and was ridden to victory by Javier Castellano. Today’s Preakness marks the first Preakness win for jockey Javier Castellano, who previously rode Ghostzapper to a win in the 2004 Breeders’ Cup Classic. The Preakness was only Bernardini’s 4th career start.

Bernardini paid $27.80 on a $2 win bet. The $2 Exacta of Bernardini and Sweetnorthernsaint (8-7) paid $171.60, the $1 Trifecta with Hemingway’s Key in third (8-7-3) paid $1,956.40, and the $1 Superfecta with 2nd-favorite Brother Derek (8-7-3-6) paid $11,151.20.

Stage collapse at Canadian “Big Valley Jamboree” kills one, and seriously injures four others

Wednesday, August 5, 2009

Two probes have been initiated into the collapse of the Big Valley Jamboree stage which killed one person, placed four others in the critical care unit and caused injuries to 75 others in Camrose, Alberta located in Canada.

“We are trying to determine from what is left of the evidence what damage was done by the wind and what damage was down by rescue workers. We may not be able to make that determination. So that is going to hamper things. It will be tougher,” Chris Chodan, spokesman for Alberta Occupational Health and Safety.

Panhandle Productions has brought in independent investigators to determine why the stage collapsed and to collect evidence. Due to the large number of people trapped under the stage the evidence had to be moved for rescue operations.

The stage collapsed shortly before 6:00 p.m. local time on Saturday killing 35-year-old Donna Moore, who was attending the festival from Lloydminster. Premier Global Productions supplies the stage for the event, which are transported from venue to venue in sections via three semi trailers. “It’s their stage. In fact, I know this stage has been used by Paul McCartney, it’s been used by Metallica, and by Tim McGraw on tour.” said Larry Werner the producer from Panhandle Productions.

The stage is suspected to have been brought down by a phenomenon called plough wind, which produces winds similar to a tornado. This particular front hit speeds greater than 100 km/hr (62 mi/hr). A plough wind travels in narrow straight line paths rather than in circular formations, but causes damage similar to that inflicted by a tornado.

Alberta Municipal Affairs has initiated their investigation into the engineering specifications of the stage and emergency procedures. Alberta occupational health and safety is investigating building codes.

The Big Valley Jamboree is a large annual country music festival located in Camrose, Alberta, Canada which sees 25,000 people attending the four day event.

Banned film ‘The Profit’ appears on Web

Banned film ‘The Profit’ appears on Web
Posted by Admin , No Comments

Sunday, March 23, 2008

Copies of The Profit, a 2001 film blocked from distribution in the United States due to a court injunction won by the Church of Scientology, appeared on the Internet Friday on peer-to-peer file-sharing websites and on the video sharing site YouTube.

Directed by former film executive Peter N. Alexander, the movie has been characterized by critics as a parody of Scientology and of its founder L. Ron Hubbard. Alexander was a Scientologist for twenty years, and left the organization in 1997. The film was funded by Bob Minton, a former critic of Scientology who later signed an agreement with the Church of Scientology and has attempted to stop distribution of the film. Alexander has stated that the movie is based on his research into cults, and when asked by the St. Petersburg Times about parallels to Scientology and L. Ron Hubbard said: “I’ll let you draw that conclusion … I say it’s entirely fictional.”

The film was released in August 2001, and was shown at a movie theatre in Clearwater, Florida and at a premiere at the Cannes Film Festival in France. A Scientology spokesman gave a statement at the time saying “the movie is fiction and has nothing to do with Scientology”. The Church of Scientology later took legal action in an attempt to stop further distribution of the film. The Church of Scientology claimed that the film was intended to influence the jury pool in the wrongful death case of Scientologist Lisa McPherson, who died under Scientology care in Clearwater, Florida.

In April 2002, a Pinellas County, Florida judge issued a court order enjoining The Profit from worldwide distribution for an indefinite period. According to the original court injunction received by Wikinews, the movie was originally banned because the court found that it could be seen as a parody of Scientology. In his April 20, 2002 ruling on the injunction, Judge Robert E. Beach of the Sixth Judicial Circuit Court in Pinellas County, Florida wrote: “…an average person viewing the film entitled The Profit could perceive that it is a parody of the Church of Scientology”.

“To the extent that any person considered as a potential juror in evaluating any issues involving the Church of Scientology, the process of voir dire provides a fair and complete remedy to eliminate any potential juror that may possibly have been influenced to be less than fair and impartial,” added Beach.

Luke Lirot, the attorney for the film’s production company, announced on the film’s website on April 7, 2007 that “We have absolutely no exposure for any repercussions from the court order,” but that the film was still blocked from distribution due to an ongoing legal battle. Lirot wrote: “all that’s stopping the release of the movie is the legal battle with the partner who was compromised by Scientology (Robert Minton) and is currently using his power as partner to stop the release of the film.”

In an October 2007 article, The Times described the film as “banned in the US because of a lawsuit taken out against it by The Church of Scientology,” and Russ Kick’s The Disinformation Book of Lists included the film in his “List of 16 Movies Banned in the U.S.”. An 8-minute teaser segment from The Profit appeared on the film’s website and on the video sharing site YouTube in February 2008, and an attorney representing Bob Minton sent a letter to Luke Lirot requesting that the film clip be taken down. In a response letter, Lirot wrote that “Rather than damage any asset of the LLC, the short clip merely keeps the film in the public eye, and in a positive way.”

On Friday, copies of the film began to circulate on peer-to-peer file-sharing websites and on YouTube. A link related to the film’s appearance on the Internet on the community-based link aggregator website Digg.com had 3,638 “Diggs” – and hit the front page of the site’s Entertainment section on Saturday.

I had nothing to do with this release at all. But I’m happy it’s out there.

On Saturday, Scientology critic and Emmy award-winning journalist Mark Bunker put a streaming version of the film on his website, www.xenutv.com, and encouraged others to watch and discuss the film on a real-time chat channel. In a video posting to YouTube Saturday, Bunker said “I did not do it. I had nothing to do with it … I had nothing to do with this release at all. But I’m happy it’s out there … people are finally having a chance to see it. A lot of people have been curious over the years and there’s been a lot of interest in seeing the film, so finally you can.”

We have all wanted to see this movie that scientology kept hidden away from us. We have all wondered just how damning could this story be that we were banned from watching it.

On the newsgroup alt.religion.scientology, a poster by the username “Alexia Death” commented on the film’s appearance on the Internet in the context of censorship: “It is out! And so it is a WIN if many people review it even if they say it SUCKS! … Being bad is no cause to allow censorship … And being censored is no cause to assume its good”. A post to the blog Blogsreel commented: “We have all wanted to see this movie that scientology kept hidden away from us. We have all wondered just how damning could this story be that we were banned from watching it.”

In a post on Sunday to the message board attached to the official website for the film, attorney Luke Lirot asked that individuals stop distributing copies of The Profit over the Internet. Lirot wrote: “It has been brought to my attention that several unauthorized transmissions and downloads of this protected work have taken place over the last 72 hours. Such actions are copyright violations and are unlawful. I request that any further distribution and/or dissemination of this important work cease immediately and any copies of the work that have been downloaded please be deleted.” In his statement, Lirot recognized the rights of individuals under the First Amendment to the United States Constitution, but also said that unauthorized distribution of the film “will only serve to harm the goal of vast distribution”.

Blog postings have attributed the film’s appearance on the Internet as part of the anti-Scientology movement Project Chanology organized by the Internet-based group Anonymous, but this has not been confirmed. Wikinews previously reported on international protests against Scientology which took place as part of Project Chanology on February 10 and March 15. A third international protest by Anonymous is scheduled for April 12. Titled “Operation Reconnect”, the third international protest will focus on highlighting Scientology’s practice of disconnection.

Plane carrying arms to Nepal detained in Gujarat

Plane carrying arms to Nepal detained in Gujarat

Thursday, August 31, 2006

A Russian-made aircraft carrying sophisticated arms and ammunition to Nepal has been detained in Ahmedabad. The Jana Astha reported that the plane’s cargo, which was comprised of rifles, ammunition and anti-aircraft guns, was probably made in Israel. The lack of documents regarding the cargo made Indian authorities suspicious, prompting them to order the aeroplane to land after it entered Indian airspace. The plane, headed for Kathmandu has been on the tarmac at the Sardar Patel International Airport for six days now.

According to reports, the consignment is part of a deal struck between Nepal and the manufacturer of the arms, at a time when both India (the largest supplier of arms to Nepal) and the U.S have suspended military dealings with the King to show their displeasure at his attempts to suppress democracy in his country. India has contacted the Nepalese embassy in New Delhi about this matter

India has long been supplying military equipment to its Himalayan neighbour, that too at a 70% subsidy. Many Nepalese governments however, failed to make payments, thereby resulting in a credit amount of several million rupees. India waived the dues as a goodwill gesture when Nepal’s PM Girija Prasad Koirala visited New Delhi this June.
